These terms are an agreement between you and FootingIQ, operated by Nick Hallmark, a sole proprietor based in the Commonwealth of Virginia, United States ("FootingIQ", "we", "us"). By creating an account or using FootingIQ you agree to them. Questions: support@footingiq.com.
1. What FootingIQ is
FootingIQ is a web app that helps you maintain horse arena footing. It generates a maintenance schedule for your arena based on its footing type, construction, your logged maintenance and riding activity, and local weather; it lets you log work and rides (with photos on some plans), track surface condition over time, and ask questions of an AI footing expert in chat. It is a planning and record-keeping tool for arena owners, managers and their staff.
FootingIQ is a website. You use it in your browser at footingiq.com, and you can add it to your phone's home screen so it opens like an app. It is not distributed through the Apple App Store or Google Play, and no app-store terms apply to it. The service is offered to users in the United States, the EU/EEA, the United Kingdom and Switzerland.
2. Your account
- You sign in with your email address, either with a one-time code we email you or with a password you set. A Continue with Google option may also be offered. Keep your email account and password secure — anyone who can use them can sign in as you. Tell us at once if you believe your account has been compromised.
- You must be at least 16 years old (or the age of digital consent in your country, if higher) to use FootingIQ. If you are using FootingIQ on behalf of a business, you confirm you have authority to bind it to these terms.
- Accounts are personal. On the Barn plan the arena owner may invite staff, each with their own account and a role the owner assigns; staff can see and add to that arena's data. The owner is responsible for who they invite and for removing people who should no longer have access. Outside of that, do not share one account across multiple people.
- You are responsible for the accuracy of what you log — the schedule is only as good as the data behind it.
- You can delete your account at any time from the Account page. Deletion is immediate, cancels any active subscription, and removes your data as described in the Privacy Policy.
3. Plans, trials and billing
- Free: one arena with logging, the full rule-based maintenance schedule, and data export, at no charge.
- Solo: $19 per month or $190 per year — one arena plus the AI footing expert chat, weather advisories with weather-adaptive scheduling, and condition trend charts.
- Pro: $49.99 per month or $499 per year — everything in Solo plus unlimited arenas, photo logging, and cost tracking.
- Barn: $99 per month or $990 per year — everything in Pro plus staff accounts for your team and priority AI.
- Currency: all prices are in US dollars (USD) and are charged in USD. If your card is in another currency, your card issuer converts the amount at its own exchange rate and may add a foreign-transaction fee; we do not control or receive that fee. The current list is on the pricing page; prices may change for future billing periods with advance notice.
- Taxes: prices are shown exclusive of VAT and sales tax. Where the law requires us to collect it, the applicable VAT or sales tax is calculated from your billing address and added at checkout, and appears on your Stripe receipt.
- Trial: every paid plan starts with a 14-day free trial. A payment method is collected up front; you are charged when the trial ends unless you cancel first. Cancel during the trial and you pay nothing. One trial per account.
- Cancellation and plan changes are self-serve: switch plans, update your card, or cancel any time through the billing portal linked from the Account page (Manage billing). Cancellation takes effect at the end of the current billing period; you keep paid access until then.
- Refunds: apart from the withdrawal right described in section 4 and any other refund the law requires, we do not offer refunds. The 14-day free trial is your chance to evaluate a plan at no cost — cancel any time before it ends and you are never charged. Once a payment is taken it is non-refundable, and cancelling stops future renewals but does not refund the current billing period.
- Downgrade: if your subscription ends or you move to a smaller plan, features above your new plan switch off but nothing is deleted. Extra arenas beyond your plan's limit become read-only — you keep full access to their history and can export their data, but they take no new logs until you re-upgrade. Staff access ends when a Barn plan ends. Your data is never deleted because a subscription lapsed.
- Payments are processed by Stripe. Card details are entered directly with Stripe and never touch our servers; we never see or store your card number.
4. Right of withdrawal (EU/EEA, UK and Swiss consumers)
If you live in the EU/EEA, the United Kingdom or Switzerland and you subscribe as a consumer (not for a business), you have the right to withdraw from a paid plan within 14 days of starting it, without giving a reason.
- The free trial already covers this window. Every paid plan begins with a 14-day free trial, so no charge is taken before the day your withdrawal period would normally end. Cancelling during the trial withdraws you at no cost.
- How to withdraw: cancel from the Account page (Manage billing → cancel), or email support@footingiq.com with a clear statement that you are withdrawing (for example, "I withdraw from my FootingIQ subscription" with the email address on your account). No form is required. We confirm receipt by email.
- Refund: if a payment has been taken and you withdraw within 14 days of that first payment, we refund it in full, to the payment method you used, within 14 days of receiving your withdrawal.
- By starting a paid plan you ask us to provide the service during the withdrawal period. The schedule, weather advisories and AI chat are delivered immediately, and you keep access to your data and to the Free plan after withdrawing.
5. AI guidance — what it is and isn't
FootingIQ's schedules, advisories, and chat answers are informational guidance, not professional advice. They are generated by software, including an AI language model, from the information you and weather services provide — and they can be wrong, incomplete, or wrong for your specific arena.
They are not engineering, construction, veterinary, or safety advice. Whether an arena surface is safe to ride on is a judgment only you, on the ground, can make. Inspect your surface before riding, and consult a qualified professional (footing contractor, engineer, veterinarian) for decisions involving construction, drainage, equipment, or horse or rider health and safety.
Chat messages are processed by third-party AI model providers via OpenRouter, subject to those providers' terms. Don't include sensitive personal information in chat. You are responsible for how you act on FootingIQ's suggestions, including the operation of watering, dragging, and tilling equipment.
6. Your content, location and notifications
- Photos and logs you upload remain yours. You give us only the permission needed to store them and show them to you and the staff you invite. Upload only content you have the right to use, and nothing unlawful or offensive.
- Location is optional. Use my location asks your browser for your device's position only when you tap it; you can type a place name instead at any time.
- Push notifications are opt-in reminders. Delivery depends on your device and browser and is not guaranteed — never rely on a notification as the only safeguard for something time-critical.
7. Acceptable use
Use FootingIQ for its intended purpose. You agree not to:
- use the AI chat for purposes unrelated to arena footing and maintenance, or attempt to manipulate it into ignoring its instructions;
- probe, scrape, overload, or interfere with the service, or attempt to access other users' data;
- resell or provide the service to third parties, or share one account across multiple unrelated users or businesses (Barn staff accounts are the supported way to share an arena);
- use the service in violation of any applicable law.
We may apply reasonable usage limits (for example, a daily cap on chat messages, or a storage limit for photos) and may suspend or terminate accounts that violate these terms, with notice where practical.
8. Your data
Your arena data, logs, photos, and chat history belong to you. We use them to run the service as described in the Privacy Policy — we don't sell them and we don't use them for advertising. You can download all of your account data from the Account page, export individual arenas, and delete your account at any time, all self-serve.
9. Availability and changes to the service
We aim to keep FootingIQ available and working well, but it is provided "as is" and "as available" — we don't guarantee uninterrupted service, and weather data, AI responses, and third-party services we depend on can fail or change. We may add, change, or remove features over time; if we ever discontinue the service or remove something material to paying users, we will give reasonable notice so you can export your data. For consumers in the EU/EEA and UK, this section does not reduce your statutory right to a service that conforms to the contract.
10. Limitation of liability
To the maximum extent permitted by law: FootingIQ and its operator are not liable for indirect, incidental, special, or consequential damages — including injury to horses or riders, damage to arena surfaces, bases, or equipment, or lost profits — arising from your use of, or inability to use, the service. Our total aggregate liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim arose (or $50 if you have paid nothing).
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited. In particular, if you are a consumer in the EU/EEA, the UK or Switzerland, nothing here limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or intent, or for breach of the statutory guarantees that apply to digital services in your country, and the limits above apply only to the extent your local law allows them.
11. Consumer rights in the EU/EEA, UK and Switzerland
If you live in the EU/EEA, the United Kingdom or Switzerland and use FootingIQ as a consumer, you keep every right that the mandatory consumer-protection law of your home country gives you, whatever the governing-law clause below says. Those rights sit on top of these terms; where these terms conflict with them, your local law wins. In particular:
- the 14-day right of withdrawal in section 4;
- statutory guarantees that the service conforms to its description and works as a reasonable person would expect, including the remedies your law provides if it does not;
- the right to bring a claim against us in the courts of the country where you live, and to be sued only there (see section 12).
We are not obliged to, and do not, take part in dispute-resolution proceedings before a consumer arbitration board. Our informal process in section 13 is always open to you.
12. Governing law and courts
These terms are governed by the laws of the Commonwealth of Virginia and the federal laws of the United States, without regard to conflict-of-law rules. Subject to the consumer carve-out below, any dispute that is not resolved informally (section 13) is brought in the state or federal courts located in Virginia, and you and we accept the jurisdiction of those courts.
Consumer carve-out. If you are a consumer in the EU/EEA, the UK or Switzerland, this choice of Virginia law does not deprive you of the protection of the mandatory laws of the country where you live, and you may bring proceedings against us in the courts of that country. We will bring any proceedings against you only in the courts of the country where you live.
13. Resolving disputes
Talk to us first. If you have a problem with FootingIQ, email support@footingiq.com with a description of the issue and what you would like us to do. We will reply within 14 days and work with you in good faith to resolve it. Most issues — billing mistakes, access problems, data requests — are fixed this way.
If we cannot resolve it informally within 60 days of your first email, either of us may take the matter to the courts described in section 12. These terms contain no arbitration clause and no class-action waiver: you are free to bring a claim in court, including a small-claims court where available.
14. Language
These terms are written in English, and the English version governs. If we ever provide a translation for convenience and it differs from the English text, the English text applies, except where the law of your country requires otherwise.
15. Changes to these terms
We may update these terms as the service evolves. We will update the "Last updated" date above, and for material changes we will notify you in the app or by email at least 30 days before they take effect. Continuing to use FootingIQ after changes take effect means you accept the updated terms; if you don't, stop using the service and delete your account (and cancel any subscription — a cancellation made because you reject a material change takes effect before the change applies to you).
